Asians' Powers Terms of Use - For Technical Intern Trainee Applicants -

The Asians' Powers Website ("Website") aims for staff matching between technical intern trainee applicants who intend to acquire advanced technical skills, technology, and knowledge in Japan under the "Technical Intern Training Program" and Japanese industries that are willing to accept and provide training for them.
By using this Website, member technical intern trainee applicants agree to be legally bound by and act in accordance with the Asians' Powers Terms of Use ("Terms of Use").

1. General

1. Operation of This Website
This Website is operated by the International Business Association ("Association") and its secretariat is located in the Association (7-110 Hanajirikikyou-cho, Kita-ku, Okayama-shi, Okayama 701-0132).
2. Definitions
(1)"Member Technical Intern Trainee Applicant" ("Member Applicant") means any registered member who is an applicant for the technical intern training.
(2)"Member Sending Organization" means any registered member outside Japan who is responsible for sending Member Applicants to Japan.
(3)"Member Supervising Organization" means any Japanese registered member who is responsible for accepting technical intern trainees.
(4)"Member Accepting Company" means any Japanese registered member who provides technical intern training for technical intern trainees.
3. Membership
(1)Membership of this Website consists of Member Applicants, Member Sending Organizations, Member Supervising Organizations, and Member Accepting Companies.
(2)To register as a member, follow the prescribed procedures for membership registration. Once approved by the Association, membership is established.
(3)The following individual, organization, or company should not register as a Member Applicant:
  1. Individuals who are not qualified to apply for the "Technical Intern Training Program";
  2. Individuals, organizations, or companies that are unrelated to the "Technical Intern Training Program";
  3. Others who are disqualified as a Member Applicant of this Website by the Association.
4. Personal Information of Members
(1)The Association will collect the personal information of Member Applicants ("Personal Information A") for the purpose of providing the personal and work histories of Member Applicants of this Website for Member Supervising Organizations and Member Accepting Companies of this Website.
(2)Concerning the personal information collected, please refer to the "Privacy Policy" provided separately.
5. Membership Fee
Member Applicants may use this Website free of charge.
6. How to Become a Member and Provision of Services
By agreeing to the "Terms of Use" and providing all the required information during the new registration process, an applicant for the technical intern training will become a member of this Website and the services of this Website will be made available to them.
7. Affiliation of Member Applicants
(1)Member Applicants may choose a Member Sending Organization to which they belong during the registration process of this Website.
(2)Member Sending Organizations may contact and recruit Member Applicants who are undecided on their Sending Organization via phone, Email, or otherwise. Only after such Member Applicants have chosen their Member Sending Organization on their Management Page, their affiliation is determined.
(3)Member Applicants may change their Member Sending Organization on their own will.

2. Registration and Translation

1. Staff Information
(1)To register as a member, an applicant for the technical intern training must enter their personal history (Personal Information A), work history, requests and other information in the language of their country using an internet-connected PC or smartphone.
(2)A Member Sending Organization may enroll an applicant for the technical intern training as a member after obtaining the written consent of the applicant only if the applicant is unable to do so with good cause.
(3)Member Sending Organizations chosen by Member Applicants must confirm the registration details provided by the Member Applicants and translate into Japanese.
2. Employment Opportunities for Technical Intern Trainees
(1)Member Accepting Companies (or Member Supervising Organizations) enter employment opportunities information for technical intern trainees in Japanese using an internet-connected PC.
(2)The secretariat of this Website translates the employment opportunities information for technical intern trainees from Japanese into another language such as English, Vietnamese, etc. This, however, does not apply when a Member Accepting Company or Member Supervising Company is able to translate.

3. Update of Registered Information

1. Update of Member Applicant Information
(1)In case of any change in the registered member information, a Member Applicant must immediately update the information accordingly and notify their sending organization of the updated details.
(2)The Member Sending Organization must promptly reflect the member information updated by the Member Applicant in the Japanese page.
2. Update of Employment Opportunities Information for Technical Intern Trainees
(1)In case of any change in the registered employment opportunities information for technical intern trainees, a Member Accepting Company or Member Supervising Organization must immediately update the information accordingly and notify the secretariat of this Website of the updated details.
(2)The secretariat of this Website updates the employment opportunities information posted in the language of affiliated countries that cannot be translated by a Member Accepting Company or Member Supervising Organization. This, however, does not apply when the Member Accepting Company or Member Supervising Company is able to translate.

4. Member Responsibilities

1. Use of This Website
Members will use this Website at their own risk.
2. Password Management
It is the sole responsibility of members of this Website to maintain the confidentiality of their password used in this Website.
3. Prohibited Activities
Concerning the use of services provided in this Website, Member Applicants agree not to knowingly:
(1)Register as a member impersonating any person, whether actual or fictitious;
(2)Register fictitious personal/work histories;
(3)Reproduce and use the personal information of other Member Applicants;
(4)Share one's password with, or transfer one's password to, any third party;
(5)Share one's password with, or transfer one's password to, any third party;
(6)Reproduce, edit, sell, publish, or otherwise use any information including the personal information obtained through the services of this Website in violation of copyright law;
(7)Attempt to seriously undermine the relationship between the members using the services of this Website and the secretariat of this Website.
4. Suspension
The secretariat of this Website will have the right to suspend access to the services of this Website temporarily or permanently without notice depending on the degree of violation:
(1)when a member breaches the "Terms of Use";
(2)when the secretariat of this Website believes that there is any other serious cause making it difficult to continue the services.

5. Membership Cancellation

1. Membership Cancellation of Member Applicants
(1)Member Applicants may cancel their membership at any time.
(2)Member Applicants must cancel their membership immediately after they are chosen as technical intern trainees. Otherwise, the secretariat of this Website may cancel their membership.
(3)Member Sending Organizations may cancel the membership of Member Applicants on their behalf after obtaining their written consent only if they have a valid reason not being able to do so.

6. Changes and Suspension of Terms of Use and Services

1. Change of Terms of Use
The Association reserves the right to change the "Terms of Use" at any time without notice. Members' continued use of this Website after any such change constitutes their agreement to the "Terms of Use" as modified unless otherwise specified.
2. Changes and Suspension of Services
(1)The staff information and employment opportunities information posted on this Website may be modified or removed without notice.
(2)The Association reserves the right to change, suspend, or terminate any aspect of the services provided through this Website at any time without notice.
(3)The Association may temporarily suspend the provision of the services at its sole discretion without notice on the occurrence of any of the following events:
  1. system maintenance and repairs;
  2. problem with computer server equipment or interruption in internet services;
  3. any circumstances beyond the reasonable control of the Association, including but not limited to earthquakes, typhoons, fires, and power outages;
  4. if an event occurs and the Association deems it to be appropriate to suspend the provision of the services for technical reasons.
Where the Association suspends the provision of the services, it will only be obliged to recommence provision immediately.

7. Disclaimer

1. Disclaimer of Warranties
(1)The staff information and employment opportunities information posted on this Website are registered by the members of this Website. The Association will not give any warranty that any such information will be accurate or complete at any particular time or at all, nor will the Association answer inquiries about the information registered by the members of this Website.
(2)The Association will not be liable for any losses or damages incurred by the members of this Website arising from the use of the personal information obtained through this Website by members of this Website or any use or reproduction of the personal information by any third party, which is not a member of this Website.
(3)The Association accepts no responsibility for any claim or dispute arising among the members of this Website. The members agree to resolve such claim or dispute at their own responsibility and cost and to hold the Association harmless from and against such claim or dispute.
(4)The Association excludes all liability whatever in respect of any loss or damage resulting or arising from any non-availability of this Website or the features of this Website.
(5)The Association will not give any warranty that information on any other website to which this Website provides a link will be accurate, nor will the Association be held liable for any losses or damages arising from the use of information presented on any such other website.

8. Other

1. Governing Law and Jurisdiction
(1)The "Terms of Use" and the "Terms of Use for Paying Members" shall be governed by and construed in accordance with Japanese law.
(2)The Okayama District Court shall be the exclusive agreement jurisdictional court of the first hearing for any disputes arising between the Association and a member.
Bylaw
The trial period of this Website shall end on 31st August 2017. The official launch date shall be set for 1st September 2017.
